AyalaLand Malls, Inc.  ( the "Company") respects your privacy and is committed to protecting your personal data. We strive to provide a safe and secure online experience and ensure that we comply with the Data Privacy Act of 2012.

This Privacy Notice sets forth the online data collection, usage, maintenance, disclosure and security policies that apply when you disclose your personal information in connection with the Ayala Malls Merchant Portal ( the "Site") and the services provided through it, such as  sending by merchants of sales report and Creditable Withholding Tax (CWT) Certificates to Ayala Malls and sending by Ayala Malls of announcement and circulars, and statements of account (the “Services”). 

As a fully-owned subsidiary of Ayala Land, Inc., the Company processes information pursuant to the Ayala Land Group Privacy Policy (the “Privacy Policy”). We have highlighted here our privacy policy and practices specific to the Company and this website. 1. WHAT PERSONAL INFORMATION WE COLLECT FROM YOU

Personal information is information that can be used on its own or with other information to identify, contact, or locate a single person or to identify an individual in context. When you use the Site and provide your personal information, AyalaLand Malls, Inc. collects and processes personal information about you. The Company collects and processes the following personal data from you as provided under User Account Information function:

  • First name, Middle name, Last name
  • Profile picture
  • Email Address
  • Contact numbers such as Mobile number or landline
  • Tax Identification Number (TIN)

Every month, merchants send sales report and CWT certificates using the Site too.
 

2 . HOW YOUR PERSONAL INFORMATION WILL BE USED

The Company processes your personal information for the following purposes:

  • sending announcements and circulars
  • preparation and releasing of statements of accounts for financial transactions, such as the rental payments, and other actions necessary or desirable in the implementation of our contract
  • sending collection letters and other communications related to the lease
  • receiving of sales report and CWT certificates
  • dissemination of survey questionnaires for service assessment, improvement, and planning
  • Providing you with product and services that you have requested, including customer support;
  • Enhancing your merchant experience by delivering product services that match your preference and needs;
  • Communication of relevant services, advisories, and responses to your queries, requests, and complaints;
  • Providing you with information about our products and services which may be of interest to you;
  • Compliance with the requirements of the law and legal proceedings, such as court orders, and legal obligations; prevention of imminent harm to the public; and ensuring public security, safety, and order;
  • Prevention, detection, and investigation of crime, including fraud and money-laundering, and analysis and management of other commercial risks; and
  • Processing of information for statistical, analytical, and research purposes
 

3. PERSONAL INFORMATION SHARED WITH THIRD PARTIES

In order to fulfill the purposes set forth in this Notice and the Privacy Policy, we may disclose your personal information to the following parties:

  • Company employees and officers;
  • Professional advisers such as lawyers and auditors;
  • Authorized third-party services providers such as but not limited to administration service processors,  technology partners, payment processors
  • Our joint venture and alliance partners;
  • Members of our group of companies or our subsidiaries and affiliates;
  • Our holding company Ayala Land and all its subsidiaries and affiliates
  • Any third-party business offering goods and services or sponsor contest or other marketing and promotional programs, where you have provided your consent
  • Such other party whom you authorize us to disclose your Personal information.
Any company with which we share information about you for the above purposes is contractually required to comply with confidentiality standards, undertake to respect any individual's right to privacy, and comply with the Data Privacy Act. We also require that these organizations use this information only for our purposes and follow our reasonable directions with respect to this information. This includes organizations which handle or obtain personal information as service providers for Ayala Land.
 

4. HOW WE PROTECT AND SECURE YOUR INFORMATION

When you submit information to our Site, whether it is name or email, we do our utmost to ensure that information is protected against loss, misuse, alteration, destruction or unauthorized access.
We maintain physical, technical, and organizational safeguards to protect your personal information against loss, theft, unauthorized access, disclosure, copying, use, or modification. We employ the following practices to secure access to your personal information:

  • Use of secured servers behind advanced threat protection appliances, firewalls, encryptions and other security tools.
  • Use of standard encryption tools such as SSL (Secure Socket Layer) to help protect personal information and to keep information collected secure.
  • Website security testing conducted by a third party prior to it being launched and when major changes has been applied

  • To the extent required by or pursuant to our contract; and

  • You may instruct us at any time not to process your personal information for marketing purposes
     b. UPDATING YOUR PERSONAL INFORMATION
           
          If you need to access, correct and/or update your personal information, you may send the request to  to ayalamallsdataprivacy@ayalamalls.com.ph The Company shall make all reasonable efforts to
          ensure that data collected is current, complete and accurate.

          As part of our security measures, we will contact you and conduct the necessary verification measures to process your request. Once we have implemented the necessary corrections, we shall then
          notify you that your request has been processed and completed.

      c. WITHDRAWAL OF CONSENT

            If you wish to withdraw your given consent for any or all purposes set out in this Notice kindly send your detailed request to  ayalamallsdataprivacy@ayalamalls.com.ph.
            Depending on the nature of your consent withdrawal, the Companymay no longer be in a position to continue to provide products and services to you.

8    YOUR DATA PROTECTION RIGHTS

Our company would like to ensure that you are aware of your data protection rights. You have the right:

    • what personal information the Company obtains about you,

    • how these are collected, processed and disposed

    • any data breach incident that affects your personal information

  • To access by requesting the Company for copies of your personal data. We may charge you a small fee for this service.

  • To object to the processing of your personal information by the Company subject to reasonableness and other certain conditions

  • To erasure or blocking by requesting the Company to suspend, withdraw, remove or destroy your personal information subject to certain conditions

  • To data portability by requesting the Company to transfer your personal information that we have collected to another organization, or directly to you, subject to certain conditions.

  • To file a complaint with the National Privacy Commission (NPC)

Privacy Policy Revisions and Updates

The Privacy Policy may be revised or updated from time to time  to ensure that it is always in accordance with laws, rules or issuances, existing or subsequently to be issued, which are applicable to the Site and/or the Services and any additional features which may be introduced to the Site. In case material changes were made to the Privacy Policy, the Company will issue a notice stating the changes made and indicating the effecitivty date of these changes.
